It was an honor for Attorney Ashley Passero to be invited to serve as a featured speaker at the 46th Annual Construction Law and Public Contracts Seminar, an event that brings together attorneys representing clients in the construction and public contracts field. This seminar was co-hosted by the Virginia Law Foundation/Virginia CLE and the Construction Law and Public Contracts Section of the Virginia State Bar.
Ms. Passero’s presentation focused on restrictive covenants—a timely and evolving topic that includes non-compete agreements, non-solicitation clauses, and confidentiality provisions. With increased federal scrutiny and recent developments under Virginia law, these covenants are more important than ever for employers, employees, and contractors to understand. Ms. Passero discussed the recent amendment to Virginia’s “low wage employee” law, prohibitions on covenants designed to prohibit employees to speak out about sexual assault and harassment in the workplace, effective drafting tips, and ways to challenge restrictive covenants in court.
